A national consultation on whether to issued Fixed Penalty Notices to households who do not comply with regulations surrounding fly-tipping is underway.

At the moment if a person fails in their duty of care to ensure their waste is passed to an authorised person, the only option for the local authority is to take the offender to court.

However, a new fixed penalty notice (FPN) for the householder waste Duty of Care could be implemented after Defra and the Welsh Government consulted on proposals to tackle crime and poor performance in the waste sector. Views and comments on the proposals are being sought.
