What is a Local Land Charges Search and Why Do I Need One?

A local land charge is a restriction on a piece of land or property. It can limit its use or be binding on successive owners. It provides prospective purchasers with information about the property.

When buying a property or piece of land, it is important that a local land charges search is carried out to make sure there are no issues affecting the land or property. 

Official Local Land Charges Information

A full official local authority search is made up of two parts: LLC1 and CON29.  

The LLC1 certificate reveals all entries on the local land charges register, such as:

  • Financial charges
  • Tree preservation orders
  • Conservation area
  • Conditional planning consents
  • Improvement grants

The form CON29 reveals issues such as:

  • Who maintains the road the property is on
  • The planning history of the property
  • The building control history of the property
  • Traffic schemes
  • Compulsory purchase orders
  • Proposed tree preservation orders
  • Other notices that may affect the property

Optional information can be provided by using the form CON29O, such as:

  • Road proposals
  • Public footpaths
  • Common land and village greens

Additional information can be specifically requested such as:

  • Development proposals within 200 metres of your property.

  • Law Society CON 29 Enquiries of local authority (2016)

Your search request must include the full postal address of the property or land to be searched, accompanied by a copy of an up-to-date location plan. This should show the boundaries of the property or land, clearly marked in red.

National Land Information Service (NLIS)

Personal Searches and EIR

There is another type of search commonly referred to as a ‘personal search’.

Any member of the public, conveyancer, solicitor or third-party companies, commonly known as personal search companies acting on behalf of a solicitor, can carry out a personal search of the Statutory Local Land Charge Register for free.

The register information is provided via email upon receipt of a request to 

landcharges@erewash.gov.uk

Personal search companies interpret and compile the register information in their own search format.

A personal search is not a local authority product.

The Environmental Information Regulations (EIR) also entitle anyone to obtain other search information required to answer a CON29.

Personal Searches and EIRs are not backed by the council’s insurance and not compiled by the experts in each of the information fields.

In addition, there is no legally binding contract completed by the local authority.

Therefore, the local authority has no responsibility for any omission or misinterpretation by anyone carrying out these types of search.
